HIPAA TIPS OF THE WEEK

5.12.08 TIP OF THE WEEK
"When A Minor is Not A Minor"

There are many state and federal laws that need to be considered when deciding if it is okay to treat a minor and/or disclose a minor's patient information.  Generally, a minor cannot consent to treatment.  Rather, the parent or legal guardian must consent and may access the minor's health information.  A minor is defined, under Illinois law, as an individual under the age of 18.

However, there are a number of exceptions to this rule, based either on the status or medical condition of the patient, or treatment received by the patient.  Click here to view a guidance on - When A Minor Is Not A "Minor."
